Welcome to the Limo Web Designs("LWD") website (the "Site"). By accessing this Site, you agree to be bound by the terms and conditions below (the "Terms"). If you do not agree to all of the Terms, please do not use the Site. LWD may from time to time modify or revise the Terms by updating this Web page. Your use of our Site following any such change constitutes your agreement to follow and be bound by the Terms as changed. If any change is unacceptable to you, your only recourse is to terminate your use of the Site.

The Site and its Contents are intended solely for personal, noncommercial use by the users of our Site. You may download or copy the Contents displayed on the Site for the sole purpose of using the Site as a personal resource, provided that you maintain any notices contained in the Content, such as all copyright notices, trademark legends, or other proprietary rights notices. No right, title, or interest in any downloaded materials is transferred to you as a result of any such downloading or copying.

PRIVACY:

It is our policy to respect the privacy of individuals who visit the Site or provide Comments to us. By accepting these Terms, you expressly consent to the use and disclosure of your personally identifiable and other information as described in the Privacy Policy.

SECURITY:

At the current time the LWD network does not provide encryption technologies to safeguard each websites individual communications. Our server software does support security solutions, such as virtual private networks ("VPNs"), personal firewalls, and anti-virus software. LWD does nto store any credit card or other payment card information, as well as any personal information that you send to us via our website when signing up for LWD service, nor is any information encrypted using secure socket layer ("SSL") technology which prevents unauthorized persons from reading that information.

LINKED SITES:

This Site may contain links to other websites ("Linked Sites"). LWD does not operate or control any information, products, or services on the Linked Sites and does not endorse or approve any products or information offered at Linked Sites. You acknowledge and agree that your access or use of any Linked Site is at your own risk.

LWD EXPRESSLY DISCLAIMS ALL SUCH REPRESENTATIONS AND WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT AND ANY IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE. INDEMNIFICATION:

You agree to defend, indemnify, and hold LWD harmless from and against any and all claims, losses, damages, liabilities, costs, and expenses, including attorneys' fees, arising from or related to your (i) use of the Site or (ii) violation of any of these Terms.

LIMITATION OF LIABILITY:

IN NO EVENT SHALL LWD BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THIS SITE OR GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THIS SITE, WHETHER IN AN ACTION UNDER CONTRACT, NEGLIGENCE, OR ANY OTHER THEORY, EVEN IF LWD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LWD's total liability for any claim arising from or related to your use of this Site shall not exceed one hundred dollars (US$100).

OUR MISSION -  To design and deliver the best and most easily functional limousine website content manangement system on the internet.  

COSTS:

Initial set up Costs -  All website designs by LWD will have assesed an initial set up fee for artwork, graphics, server set up, hosting setup , email set up, databse set up, revisions, etc. All these standard costs will be included in the LWD set up fee page located at www.limowebdesigns.com . Additional billable costs will be assesable for work outside the scope of internal operational capability. It is the sole responsiblity of the client purchasing services from LWD to have readily available all FTP (File Transfer Protocol) usernames and passwords from current webmasters prior to signing up with LimoWebdesigns. All initial set up costs are deemed non refundable and have no bearing with functionality if client purchasing services from LWD are changing hosting providers or webmaster. For ease of  integreation , all  FTP information should be obtained immediately.

Monthly Maintenance Costs - All monthly costs associated with any chosen web site package from LWD will be billed on a monthly basis to a major credit card of client purchasing services from LWD. All monthly maintenance costs will included but are not limited to Hosting, Email Accounts. Web Site Stability, Server Stability Checks and Search Engine Optimization checks. LWD reserves the right to view, critiqe and modify any and all content that is deemed not suitable for minor audiences.

Monthly Leasing Costs – All domains owned by LWD are available for monthly leasing from LWD . An extensive list of geo-targeted domain names are available at a monthly fee. LWD guarantees a one fee for life for all monthly leasing of domains and vows a non termination of service agreement to all customers in good payment standing. LWD can terminate the monthly leasing agreement at any time if content on the current domain website is not relative to the limousine industry, contains nudity /lewd connotations or poses a conflict of interest as a competitor to  LWD or Limofind.com . Any and all limousine associated domains registered by LWD , Limofind.com or any corporate entity of WebSmart International is the sole property of Websmart International .  

CANCELLATION:

Customers reserve the right to cancel the services from LWD at any time with no cancellation penalty or early termination penalty. All up front set up costs are deemed non refundable as well as all invested costs including but not limited to advertising costs, design costs, al acarte costs etc. No prorated refunds will be dispersed for termination and termination must be requested 30 days prior to next billing cycle to avoid being charged for cycle to come. LWD will assess a $50.00 administrative fee for each month customers credit card returns declined or has been submitted as a dispute by customers credit card company. LWD reserves the right to legally pursue and hold liable the costs incurred in the attempt of debt collection for all accounts not paid and not notified to LWD as needed to cancel.

SERVICES RENDERED:

Upon submission of the online form on the sign up section of the LWD website, this agreement will have been accepted by the customer. Services will have begun at this stage and setup costs will have been charged. There are no refunds for setup costs. Once services have been complete and rendered and the customers website is deemed live (Online) , service will have been completely rendered. Customers will have a 7 day revision period to dissect, analyze and bring to surface any and all flaws, inaccuracies bugs and system errors with the customers website. Once the 7 day period has lapsed, the customer will be bound to all term conditions and cancellation policies

AGREEMENT

Both customer and LWD agree that LWD will not be held liable for any damages , loss of business or loss of use resulting from the use of the LWD software nor the inability to use the LWD software due to internet outages, server malfunctions, customers  computer malfunctions or any other reason resulting in the attempt to hold liable LWD for loss of business or damages. Customers are advised to make paper print outs of every form inquiry , reservation , driver email or contact form submitted from customers website to the customer daily.  LWD will not be held liable for database corruption and loss of data.

CONTENT – All content, images, artwork and trademarks after services rendered  are the sole responsibility of the customer. LWD will not be held accountable for copyrite infringements, duplication of contents and holds no responsibility to damages derived from customers use of the LWD content management tool.

REDUPLICATION – All site information , content , images, headers , footers, domains and graphics are the sole property and ownership of customer once all set costs have been paid. However transfer of ownership will be automatically reversed back to LWD 30 days prior to cancellation notification. All reduplication in an effort to remove site from LWD and host elsewhere is prohibited . It is the duty of the customer to fully understand that initial set up costs are solely implemented to offset labor costs and are not paid by the customer to assume rights to any header , footer or artwork designed by LWD. All customers must notify all new and prospective webmasters or web development firms of these reduplication terms. LWD reserves the right to hold any and all webmasters or web development firms legally responsible for reduplication infringements.  All accounts found to be reduplicated from a LWD design will be considered active and billable from LWD to customer even after cancellation notices have been given to LWD and account has been terminated by way of cancellation.

MISCELLANEOUS

These Terms are governed by and shall be construed in accordance with the laws of the State of New Jersery without giving effect to any principles of conflicts of law. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. These Terms are effective unless and until terminated by LWD.
